# FIT Protection — Privacy Policy

## 1. Introduction

This Privacy Policy explains how FIT Protection ("FIT," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit, browse, or purchase from **fitprotection.com** (the "Site") or otherwise interact with us. By using the Site, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Site.

We are based in Phoenix Arizona, United States.

## 2. Information We Collect

We collect the following categories of information:

**Information you provide directly to us:**

- Name, shipping address, billing address, email address, and phone number
- Order details (vehicle make, model, year, trim, color preferences)
- Payment information (processed by our payment processors — see Section 5; we do not store full card numbers on our servers)
- Communications you send us (warranty claims, support emails, contact-form submissions, reviews)
- Account credentials if you create a customer account
- Photos or other materials you submit in support of warranty claims, custom-fit requests, or product reviews

**Information collected automatically when you use the Site:**

- Device information (IP address, browser type and version, operating system, device identifiers)
- Usage information (pages viewed, time spent on pages, referring URL, click and scroll behavior)
- Cookies, pixels, web beacons, and similar tracking technologies (see Section 6)
- Approximate geolocation derived from your IP address

**Information from third parties:**

- Order and fraud-screening signals from Shopify
- Advertising and analytics signals from partners listed in Section 6
- Information from social platforms when you interact with our pages, ads, or shared content

## 3. How We Use Your Information

We use the information we collect to:

- Process, fulfill, and ship your orders
- Communicate with you about orders, warranty claims, support requests, and policy changes
- Personalize the Site and recommend products that may interest you
- Send marketing communications (only if you have opted in or where permitted by law — you can unsubscribe at any time)
- Operate, maintain, secure, and improve the Site and our products
- Detect, investigate, and prevent fraud, abuse, or unauthorized activity
- Comply with legal obligations and enforce our terms, warranty, and other policies
- Conduct analytics, research, and reporting on aggregate Site usage

## 4. Legal Bases (EEA / UK Visitors)

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with similar laws, we rely on the following legal bases to process your personal data: (a) performance of a contract with you (e.g., to process your order); (b) your consent (e.g., for marketing emails or non-essential cookies); (c) compliance with legal obligations; and (d) our legitimate interests in operating, securing, and improving our business, where those interests are not overridden by your rights.

We do not sell your personal information for monetary value. We share information in the following circumstances:

- **Service providers and processors** acting on our behalf, including: Shopify (e-commerce platform), our payment processors (Shopify Payments, Stripe, PayPal, Shop Pay, and similar — these handle card data subject to PCI-DSS), shipping carriers (USPS, UPS, FedEx, DHL, freight providers), email service providers, customer support tools, hosting and CDN providers, fraud-prevention services, and analytics providers.
- **Advertising and analytics partners** as described in Section 6.
- **Affiliated companies** in connection with our internal operations.
- **Successors** in the event of a merger, acquisition, financing, or sale of all or part of our business.
- **Legal disclosures** when required by law, regulation, subpoena, or other legal process, or to protect our rights, your safety, or the safety of others.
- **With your consent**, including when you choose to share content or reviews publicly.

Some of these disclosures may be considered "sales" or "sharing" of personal information under certain U.S. state laws (e.g., California, Colorado, Connecticut, Virginia). See Section 9 for your opt-out rights.

## 6. Cookies, Tracking & Advertising

We and our partners use cookies, pixels, SDKs, and similar technologies to operate the Site, remember your preferences, analyze traffic, and deliver advertising. Categories include:

- **Strictly necessary** (required for the Site to function — e.g., shopping cart, checkout, login)
- **Performance & analytics** (e.g., Shopify Analytics, Google Analytics) to understand how the Site is used
- **Functional** (remembering preferences, recently viewed products)
- **Advertising & retargeting** (e.g., Meta Pixel, Google Ads, TikTok Pixel, Pinterest Tag) to show you ads on other sites and measure ad performance

You can control cookies through your browser settings, our cookie banner (where displayed), and the opt-out mechanisms described in Section 9. Note that disabling certain cookies may impair Site functionality.

We honor the **Global Privacy Control (GPC)** signal as a valid opt-out request for residents of jurisdictions where it is legally recognized.

## 7. Email & SMS Marketing

If you opt in, we may send you marketing emails or text messages about new products, promotions, and educational content. **Message and data rates may apply** for SMS. You can unsubscribe at any time by clicking the unsubscribe link in any email, replying STOP to any text, or contacting us at **support@fitprotection.com**. Transactional messages (order confirmations, shipping updates, warranty correspondence) will continue regardless of marketing opt-out status.

## 8. Data Retention

We retain personal information for as long as necessary to provide the Site, fulfill orders, comply with our legal and tax obligations (typically up to seven years for transactional records), resolve disputes, prevent fraud, and enforce our agreements. We may retain anonymized or aggregated data indefinitely for analytics and product improvement.

## 9. Your Rights & Choices

Depending on your jurisdiction (including California, Colorado, Connecticut, Virginia, Utah, Oregon, Texas, the EEA, the UK, and others), you may have the right to:

- **Access** the personal information we hold about you
- **Correct** inaccurate information
- **Delete** your personal information, subject to legal exceptions
- **Port** your information in a machine-readable format
- **Opt out** of targeted advertising, profiling, or the "sale" or "sharing" of your personal information
- **Withdraw consent** for processing based on consent
- **Limit** the use of sensitive personal information
- **Appeal** a denied request, where applicable
- **Lodge a complaint** with your local data-protection authority

To exercise any of these rights, email **privacy@fitprotection.com** with the subject line "Privacy Request" and include enough information for us to verify your identity. We will respond within the timeframe required by applicable law (generally 30–45 days). We will not discriminate against you for exercising any of these rights.

**California "Shine the Light":** California residents may request a list of third parties to whom we have disclosed personal information for those parties' direct-marketing purposes in the prior calendar year by emailing the address above.

## 10. Children's Privacy

The Site is intended for adults (ages 18+). We do not knowingly collect personal information from children under 13 (or under 16 in the EEA/UK). If we learn we have collected such information, we will delete it. If you believe a child has provided us information, contact **privacy@fitprotection.com**.

## 11. International Transfers

We are based in the United States, and the personal information we collect may be processed in the United States or other countries that may have data-protection laws different from those of your country. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for cross-border transfers.

## 12. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit (TLS/HTTPS), restricted access controls, and PCI-DSS-compliant payment processing through our payment partners. **However, no method of transmission or storage is 100% secure.** We cannot guarantee absolute security, and you provide information at your own risk. If we become aware of a security breach affecting your information, we will notify you as required by law.

## 13. Third-Party Links

The Site may link to third-party websites, ads, or services that we do not control. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party site you visit.

## 14. Do Not Track

Most browsers transmit "Do Not Track" signals. Because there is no industry standard for how to respond, we do not currently respond to DNT signals. We do, however, honor Global Privacy Control as described in Section 6.

## 15. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be communicated through a banner on the Site or by email where required. Your continued use of the Site after the effective date constitutes acceptance of the updated policy.
