# FIT Protection — Terms of Service

## 1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of **fitprotection.com** and any related services, content, and products ("Site") operated by FIT Protection ("FIT," "we," "us," "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to place an order.

## 2. Products & Custom Manufacturing

All FIT covers are **custom-manufactured to order** based on the vehicle make, model, year, and trim you select at checkout. Because each cover is built to your specifications, **all sales are final** except as expressly provided in our Returns & Refunds policy. You are solely responsible for selecting the correct vehicle specifications. Manufacturing typically begins within one business day of order placement.

## 3. Pricing, Availability & Order Acceptance

Prices, promotions, and availability are subject to change without notice. The price displayed at the time you complete checkout is the price you will be charged, except in cases of obvious pricing errors. We reserve the right to refuse, limit, or cancel any order, including for suspected fraud, pricing or product description errors, limited availability, or violations of these Terms. If we cancel an order after payment, we will issue a refund to your original payment method.

## 4. Shipping & Risk of Loss

We ship to the United States and select international destinations. Shipping times are estimates, not guarantees, and may be affected by carrier delays, weather, or events outside our control. Title and risk of loss pass to you upon delivery to the carrier (or at the address you provided, where required by law). For full shipping terms, see our [Shipping policy](/pages/shipping).

## 5. Returns & Refunds

See our full [Returns policy](/pages/returns) for eligibility, timing, restocking fees (where applicable), and the process for requesting a return on the limited categories of products that are eligible for return. Custom-fit covers are not eligible for return except where covered by our Warranty.

## 6. Warranty

Each FIT cover is sold subject to FIT's [Limited Warranty](/pages/warranty), which describes what is covered, what is excluded, and how to file a claim. **The Warranty is the sole and exclusive remedy for any defect in our products.** All other warranties, express or implied, are disclaimed to the fullest extent permitted by law (see Section 11).

## 7. Acceptable Use

You agree not to:

- Use the Site for any unlawful purpose or in violation of any applicable law
- Submit false, misleading, or fraudulent information, including in warranty claims
- Resell or commercially exploit FIT products without our prior written consent
- Reverse-engineer, scrape, or systematically extract content from the Site
- Interfere with or disrupt the Site, our servers, or other users
- Upload or transmit viruses, malware, or other harmful code
- Impersonate any person or entity, or misrepresent your affiliation
- Use the Site to harass, threaten, defame, or harm any other person
- Bypass, disable, or interfere with security or access-control features

We reserve the right to suspend or terminate your access to the Site for any violation of these Terms.

## 8. Intellectual Property

The Site and all content (text, graphics, logos, photos, videos, product designs, software, and the FIT name and trademarks) are owned by or licensed to FIT and protected by U.S. and international intellectual-property laws. You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written consent.

## 9. User Submissions

If you submit reviews, photos, comments, custom-fit information, or other content ("Submissions"), you grant FIT a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and distribute the Submissions in any media for any lawful business purpose, including marketing. You represent that you own or have the necessary rights to the Submissions and that they do not infringe any third-party rights. We may remove or refuse Submissions at our sole discretion.

## 10. Third-Party Links & Services

The Site may link to third-party websites or use third-party services (e.g., Shopify, payment processors, shipping carriers). We are not responsible for third-party content, products, or services. Your use of those services is governed by the third party's terms.

## 11. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, FIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE LIMITED WARRANTY ON OUR PRODUCTS IS SET OUT IN THE WARRANTY POLICY AND IS THE SOLE AND EXCLUSIVE WARRANTY WE PROVIDE.

## 12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIT, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF REVENUE, LOSS OF DATA, VEHICLE DAMAGE, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE OR A PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.

Some jurisdictions do not allow these exclusions or limitations, so they may not apply to you. In those jurisdictions our liability is limited to the maximum extent permitted by law.

## 13. Indemnification

You agree to indemnify, defend, and hold harmless FIT and its officers, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or products; (b) your violation of these Terms; (c) your Submissions; or (d) your violation of any law or third-party right.

## 14. Governing Law & Venue

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. The exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Curry County, Oregon, and you consent to the jurisdiction of those courts.

## 15. Dispute Resolution & Arbitration

**PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.**

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product (a "Dispute") shall be resolved by **binding individual arbitration** administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court if it qualifies. The arbitration shall take place in Oregon, or another mutually agreed location, or by remote/video proceedings.

**Class-action waiver.** YOU AND FIT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

**30-day right to opt out.** You may opt out of this arbitration agreement by emailing **legal@fitprotection.com** within 30 days of your first order with the subject line "Arbitration Opt-Out" and your full name and order number.

If any portion of this arbitration provision is found unenforceable, the remainder shall remain in effect, except the class-action waiver, which is non-severable — if it is held unenforceable, this entire arbitration section is null and void.

## 16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be communicated through a banner on the Site or by email where required. Your continued use of the Site after the effective date constitutes acceptance of the updated Terms.

## 17. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, Warranty, Returns, and Shipping policies, constitute the entire agreement between you and FIT regarding the Site and products and supersede all prior or contemporaneous agreements.
